PROPOSED CHANGES TO CUSTOMS TARIFF IMPORT STATISTICAL CODES

The ABS (Australian Bureau of Statistics) is undertaking a feasibility study into the creation of specific new Customs Tariff statistical codes under subheadings 7227.90.90, 7228.70.00, 7308.90.00, 7312.10.00 and 7312.90.00. If the feasibility study leads to the creation of new statistical codes, they will be implemented on 1 January 2015. Korea - Australia Free Trade Agreement

Invitation to an information session on the Korea-Australia Free Trade Agreement (KAFTA)

 

The Australian Customs and Border Protection Service (ACBPS) is hosting information sessions on how to access preferential tariff treatment under the Korea-Australia Free Trade Agreement (KAFTA). This includes information on how to identify the relevant tariff commitment and rules of origin for the goods imported.

The sessions will provide an overview of the rules of origin chapters of KAFTA. The session will complement the ACBPS Instruction and Guidelines and Australian Customs Notice (ACN) that will become available once the agreement enters into force.

 

The information sessions are CPD Accredited for licensed customs brokers (three points in the Professional Brokerage Skills stream). Each session is scheduled for three hours, from 9 am to 12 noon. We anticipate that the presentation will take approximately two hours, with the remainder of the session dedicated to questions and answers. There is no charge for the session.

The advertised ICS outage that impacted FID processing on Friday morning rectified the calculation routines that affected GST on Transport and Insurance. Any amendments to the FIDs impacted after 10 September will result in the correct calculation routine being performed. ACBPS are still evaluating the impacted FIDs and further information will be provided after the scope of the affected FIDs is analysed.

As per ACBPS earlier advice about the ICS calculation routine issues affecting GST for Transport and Insurance(T and I), there will be a minor delay in processing FIDs.  To deliver a fix for the T and I issue, between 10:00 and 10:15 AEDT on Friday October 10 all Full Import Declarations and some Self Assessed Clearances that are submitted will be held.  They will then be processed successfully after the fix for the resolution of the T and I issue is delivered.
 
Further information about the T and I FIDs affected in the period between Wednesday 10 September and Friday 10 October will be provided after the scope of the affected FIDs is analysed.

Calculation of Transport and Insurance on FIDs

Please be aware that an issue has been discovered with the ICS calculations routine affecting the calculation of GST for all import declarations where a Transport and Insurance amount has been explicitly provided.

Impact
When an import declaration is lodged the importer/broker has the option of providing a Transport and Insurance (TandI) amount. Where the TandI is not provided the ICS will calculate an amount based upon the difference between the Cost Insurance Freight (CIF) and Free On Board (FOB) amounts and use this derived amount in further GST calculations. The issue discovered is that the ICS calculations module is ignoring any TandI amount provided and always deriving a TandI amount from the CIF/FOB amounts for use in GST calculations. The result is that an incorrect GST amount may be being calculated.

Timeframe
All import declarations lodged between Wednesday 10 September and Thursday 9 October where a TandI amount has been provided may have been affected. The impact is a possible incorrect calculation of GST.

Immediate Resolution


ACBPS have identified a fix with a plan to implement as soon as possible. The delivery schedule will be confirmed today and further advice provided.

Rectification
ACBPS are focused upon delivering a resolution to the issue. Once a plan is finalised further details will be provided outlining the necessary steps to address the impacted import declarations.
